FRAUD INVESTIGATION

The investigation and deterrence of insurance fraud is primary to HKR’s mission. We work closely with insurers and special investigation units to combat insurance fraud through coordinated claim investigations and affirmative litigation.

All successful affirmative actions start at the claim investigation stage. Our lawyers have obtained numerous trial verdicts and summary judgment awards to recover wrongfully paid coverage benefits, punitive damages, and declaratory relief rescinding policies.

Proper coordination of claim investigations and examinations under oath require mastery of the coverage issues surrounding material misrepresentations, advanced interrogation techniques, and the unique outside expert needs of certain property claims. We understand the nuances of coordinating multiple expert fields, including forensic accounting reviews associated with business income losses, or sophisticated origin and cause issues related to arson. Working closely with the right outside experts is crucial to properly vetting and proving insurance fraud.

HKR also appreciates the unique legal issues facing insurers and special investigation units in handling potentially fraudulent or inflated claims. Our lawyers regularly present trainings, seminars and legal updates to various insurers, special investigation units and fraud prevention associations involving:

  • Compliance issues surrounding mandatory fraud reporting laws;
  • Strategies for properly obtaining and preserving electronic evidence, including the evolving evidentiary issues relating to social media accounts;
  • Best practices to ensure the admissibility of recorded statements;
  • Application of legal privileges to protect special investigation files and claim files; and,
  • Advanced internet search protocols for background investigations.

Our team is ready to assist with the investigation of a potential fraud or the affirmative prosecution of a civil action.
