Melissa A. Anderson

Melissa is a seasoned litigator whose practice focuses on complex business, commercial, and insurance litigation.  She has successfully represented clients in federal and state trial and appellate courts, as well as before administrative agencies and during government investigations. Her advocacy has been described by clients, as well as adversaries, as “excellent,” “articulate,” and “forceful.” Throughout her career, Melissa has a track record of designing effective litigation strategies for her clients, including handling multiple matters that resulted in a plaintiff abandoning the litigation or agreeing to voluntarily dismiss her client without monetary settlement.  She has been named a Pennsylvania Rising Star for business litigation.

As an Associate Attorney at HKR, Melissa’s practice focuses on complex first-party coverage disputes and related extracontractual litigation.  Melissa also provides invaluable pre-litigation support to HKR’s insurer clients on claim investigation, policy interpretation, and compliance with claim handling regulations

Previously, Melissa served as a judicial law clerk to the Hon. Edwin M. Kosik, U.S. District Judge for the Middle District of Pennsylvania, as well as a pro se law clerk in both the U.S. District Courts for the District of New Jersey and the Middle District of Pennsylvania. While studying law at the University of Richmond’s T.C. Williams School of Law, Melissa was a member of the University of Richmond Law Review, the Trial Advocacy Board, and the Client Counseling and Negotiation Board.

Representative Matters

  • Represented a Fortune 100 chemicals company as litigation counsel to protect a $950MM trade secret for a proprietary product, which had been pirated by a former employee who traveled to foreign jurisdictions to assist a competitor in creating a manufacturing process using said trade secrets protected for decades.
  • Conducted internal investigation on behalf of life insurance company whose agent was alleged to have created a scheme to entice employers to purchase cash-value life insurance policies on the lives of the employers’ principals through a trust arrangement, which was alleged to violate RICO, ERISA, and common law claims of fraud, bad faith, and breach of fiduciary duties.
  • Successfully defended medical device manufacturer and employee against allegations of breach of restrictive covenant agreement and misappropriation of trade secrets with the client receiving a full award of attorney’s fees requested.
  • Successfully obtained dismissal with prejudice in favor of financial institution which was alleged to have violated consumer fraud & protection laws, unjust enrichment, constructive trust, and equitable lien regarding construction loan financing for construction of a home.
  • Developed and drafted fiduciary duty opinion for board of directors in $830MM merger of mutual insurance company, including appearing before the special litigation committee, which found no merit to putative class action.
  • Represented mortgage servicer in putative class actions regarding consumer claims of alleged force placed insurance.
  • Investigated claims of fraud and collusion related to silica claims § 524(g) trust in bankruptcy on behalf of insurer. Investigation results critical to settlement of silica claims for fraction of policy values.
